By accessing the Website and using our services, you agree to be bound by these Terms and to comply with all applicable laws and regulations. If you do not agree with these Terms, you are prohibited from using or accessing this Website or using any other services we provide.

We reserve the right to amend these Terms at our sole discretion. Upon making any changes, we will update this page. Any changes will take effect immediately from the date of publication.

1. Subscriptions and Payments

1.1 Subscription Plans

We offer various subscription plans, which may include:

• Trial Periods: We may offer trial periods that are either paid or free, depending on promotional offers. The terms of the trial, including duration and cost, will be specified at the time of sign-up. Trial periods may transition into a paid subscription, and the specifics of the offer will be presented at checkout.

All subscription plans automatically renew at the end of each term unless cancelled in accordance with our cancellation policy.

1.2 Auto-Renewal and Cancellation

Your subscription will automatically renew at the end of each billing cycle. You may cancel at any time through your account settings or by contacting us at contact@builder.tools. Cancellation will take effect at the end of the current billing period. No refunds will be provided for the remainder of the billing period after cancellation, except as set out in our Refund Policy or as required by law.

1.3 Payment Processing

All payments are processed securely through Stripe. We accept all major credit and debit cards, as well as Apple Pay and Google Pay where available. No additional fees are associated with different payment methods.

1.4 Refund Policy

Our refund policy is detailed in our Refund Policy, which is incorporated herein by reference.

• Trial Periods: If you are on a paid trial, charges apply as specified during sign-up. If you cancel during the trial period, the terms regarding refunds are as per our Refund Policy.
• After First Payment: Refunds are offered within the first 7 days after your first payment, subject to the conditions in our Refund Policy, and without prejudice to your statutory rights as a consumer.
• Subsequent Payments: No refunds are guaranteed after the first 7 days of your first payment. Refund requests beyond this period are at our sole discretion.

2. Your Content and Generated Outputs

2.1 Quotes, Estimates and Documents

builder.tools allows you to generate quotes, estimates, pricing, and related documents ("Outputs"). You are responsible for reviewing all Outputs before relying on them or sharing them with your own customers. Outputs are generated based on the information and settings you provide, and we do not warrant that any figure, calculation, or document is accurate, complete, or suitable for a particular job.

2.2 Your Responsibility for Accuracy

You are solely responsible for the prices, rates, measurements, and other information you enter, and for any quotes or estimates you issue to your own customers on the basis of our Outputs. We are not a party to any contract between you and your customers.

2.3 Availability

We aim to keep the Website and services available at all times but do not guarantee uninterrupted access. We may suspend access for maintenance, updates, or reasons beyond our control.

3. Limitations of Use

By using this Website, you agree not to:

• Modify, copy, decompile, or reverse engineer any materials or software on the Website.
• Remove any copyright or proprietary notations from any materials or software.
• Transfer, resell, sub-license, or "mirror" the Website, the services, or access to them on any other server or to any third party.
• Use the Website in a way that abuses or disrupts our networks or services.
• Transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material.

• Resell, redistribute, sub-license, or provide the services to third parties as a service of your own.
• Attempt to decompile or reverse engineer any software on the Website.
• Remove any copyright or other proprietary notations.
• "Mirror" any part of the Website on any other server.

4.3 Your Outputs

For the avoidance of doubt, the Outputs you generate for your own business (quotes, estimates, and documents) are yours to use commercially with your customers. This section does not restrict your use of your own Outputs; it restricts copying or reselling the Website, software, and underlying materials themselves.

4.4 Termination of Licence

This licence terminates automatically if you violate any of these restrictions or the Terms. We may also terminate the licence at any time.

5. User-Generated Content

5.1 Content Ownership

You retain ownership of any intellectual property rights in the content and data you create and submit using our services.

5.2 Licence to Use Content

By submitting content, you grant us a non-exclusive, royalty-free, worldwide licence to host, store, use, copy, and process your content solely to the extent necessary to provide and improve the services to you, consistent with our Privacy Policy.

5.3 Termination of Licence

You may terminate this licence at any time by deleting your content or account, save to the extent we are required to retain data for legal, accounting, or backup purposes.

5.4 User Responsibilities

6. Limitation of Liability

Our total liability to you for any damages arising from or related to these Terms or your use of the Website will not exceed the amount you have paid to us in the 12 months preceding the claim.

6.4 Exceptions

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded or limited under applicable law. Because some jurisdictions do not allow certain limitations, some of the above may not apply to you. Nothing in these Terms affects your statutory rights as a consumer.

We do not warrant the accuracy, completeness, or reliability of the materials on the Website or on any sites linked to it. This includes pricing data, rates, and calculations, which you must independently verify before relying on them.

Where you have paid in advance for a subscription period, any refund on termination will be handled in accordance with our Refund Policy and your statutory rights.
